According to an amended complaint filed by Edinboro University Head Volleyball Coach Melissa Soboleski, Athletic Director Bruce Baumgartner is being named as a defendant in the lawsuit recently filed by Soboleski. The lawsuit already includes defendants Edinboro University and the Pennsylvania State System of Higher Education (PASSHE).

On Feb. 22, Soboleski amended the complaint to add Baumgartner individually, claiming that he subjected Soboleski to "the deprivation of her rights, privileges, or immunities secured by the United States Constitution by denying her equal protection of the law on the basis of her sex (female) in contravention of the Fourteenth Amendment."

The court documents obtained by The Spectator also claim that Baumgartner violated Soboleski's 14th Amendment rights by retaliating "against her for making protected complaints about gender discrimination and the denial of equal protection on the basis of her sex."

The inital scheduling conference will be held in Pittsburgh on March 13.
